8a Contracting

Here’s a valuable labor resource for 8a contractors planning for their upcoming projects: CLP. As the leader in construction staffing, our temporary workforce solutions are designed to expertly match qualified, tested and available tradespeople to each phase of your project, and CLP meets the requirements needed to be acknowledged as an eligible provider of manpower resources on a government project in accordance with SBA guidelines.

CLP has received confirmation from the U.S. Small Business Administration that Section 8a contractors can fulfill the “self performance” requirement of their contracts when they partner with CLP and use our skilled tradespeople on their jobsites. The SBA’s Office Business Development Procedural Notice No. 8000-630 concludes that “the employees of the 8(a) BD participant that are co-employed by a PEO (Professional Employer Organization) arrangement will be deemed employees of the participant for the purposes of applying subcontractor limitations” if certain rights and responsibilities are set forth in the contract. The letter further states that while the notice refers only to PEOs, “we find no reason for the 8(a) BD program to apply the notice’s guidance differently to temporary employee agencies as compared to PEOs” and goes on to explain the reason why the guidance applies equally.

As you plan your priority bids, CLP can provide the tradespeople you need to keep your project on time and on budget.
