The SBA’s Office Business Development Procedural Notice No. 8000-630 concludes that “the employees of the 8(a) BD participant that are co-employed by a PEO (Professional Employer Organization) arrangement will be deemed employees of the participant for the purposes of applying subcontractor limitations” if certain rights and responsibilities are set forth in the contract. The letter further states that while the notice refers only to PEOs, “we find no reason for the 8(a) BD program to apply the notice’s guidance differently to temporary employee agencies as compared to PEOs” and goes on to explain the reason why the guidance applies equally.
